Art. 376 Limitation of immunity

When a judge appoints an expert to help with a case, that expert usually has some legal protection from being sued for the work they do. This protection is meant to let experts give honest opinions without worrying about lawsuits.

But this protection has a limit. If the expert lies under oath, that is perjury, and the law does not protect them for that. Perjury is a crime under Louisiana law, and no court-appointed expert can hide behind their special status if they commit it.

In simple terms, this rule means an expert can speak freely and give their honest opinion without fear of being sued for it. But if they knowingly lie in their testimony, they can still be held responsible just like anyone else who commits perjury.
