Art. 3863 Person against whom writ directed

This rule explains who a court can order to act when someone files for a writ of mandamus. A writ of mandamus is a court order that forces someone to do a specific duty they're legally required to do.

The court can direct this order at a public officer who is refusing or failing to do a task that the law clearly requires them to do. This only applies to duties that don't involve personal judgment or choice. These are called ministerial duties, meaning the officer has no discretion about whether to do them. They just have to do the job.

The rule also covers what happens when someone leaves public office. If a former officer (or that person's heirs, if they have passed away) still has official papers or property from the office, the court can order them to hand these items over to whoever took over the position. This makes sure that public records and property stay with the office itself, not with the person who used to hold the job.
