Art. 3865 Alternative writ

When someone asks a court to force a government official or agency to do something they're legally required to do, they file what's called a petition for a writ of mandamus. Once that petition is filed, the judge doesn't just decide the case right away. Instead, the judge issues an order called an alternative writ.

This order gives the other side two choices. They can either go ahead and do the act that's being demanded of them, or they can come to court and explain why they shouldn't have to do it. This gives the defendant a fair chance to respond before the court makes a final decision.

Think of it as a first step in the process. The court is saying "do this thing, or tell me why you don't have to." This sets up the next phase of the case, where the defendant will either comply or argue their side in court.
