Art. 3951 Petition for divorce

If you want to file for divorce under Civil Code Article 102, your petition needs to include certain basic information. You must state facts showing the court has jurisdiction over the case and that you filed it in the right location, or venue.

You also need to sign the petition under oath. This means you swear that the facts in the petition are true, and you do this in front of a notary or someone else who can take an affidavit. This step, called verification, adds a layer of legal accountability to what you're claiming in your petition.

Without these two things, jurisdiction and venue facts plus a verified signature, your petition may not meet the basic legal requirements needed to move forward with your divorce case.
