Art. 4063 Legal tutor

When a minor child needs someone to legally look after their affairs, the court steps in to name a legal tutor for them. A legal tutor is different from a regular guardian chosen by a parent. The court only appoints one when the law says specific conditions have been met, such as when both parents have died or can no longer care for the child.

The law also sets rules for who gets picked first. Certain relatives or people connected to the child may have priority over others when the court decides who should serve as tutor. The court follows this priority list rather than picking anyone at random.

The actual steps for appointing the tutor, like how to file the request and what the court needs to check, are laid out in separate rules (Articles 4065 through 4068). Those articles explain the process in more detail, but this rule sets up the basic requirement: the court must follow the law's conditions and priority order, and use the proper legal process, before naming someone as a child's legal tutor.
