Art. 4070 Provisional tutor

When a child needs someone to look out for them or their property right away, the court doesn't have to wait until a regular tutor is fully appointed. A judge can step in and name a provisional tutor to handle things in the meantime.

This can happen two ways. Someone with a stake in the child's welfare can ask the court to make this appointment, or the judge can decide to do it without anyone asking. Either way, the court only takes this step if it's truly needed to protect the child or keep their property safe until a permanent tutor is put in place.

This provisional tutor acts as a temporary stand-in. Their job is to handle urgent matters and prevent harm to the child or their belongings while the court works out who should be the long-term tutor.
