Art. 4237 Appointment of successor tutor or undertutor

When a child's tutor or undertutor (the person legally responsible for looking after the child's interests or property) dies, gets removed, or quits, someone new has to be appointed to take their place. This new person is chosen the exact same way the first tutor or undertutor was chosen. There's no shortcut process for finding a replacement.

This matters because it means the court can't skip steps just because someone already held the role before. The same rules, notices, and procedures used to appoint the original tutor or undertutor apply again when a replacement is needed. This helps make sure the child's interests stay protected no matter how many times the position changes hands.
