Art. 4302 Terms of sale

When a minor's property is sold, the sale normally has to be paid for in cash right away. This protects the minor's interests by making sure the money comes in fully and immediately.

There is an exception. If the tutor (the person who manages the minor's affairs) asks the court, the judge can allow the property to be sold on credit instead of cash. This means the buyer could pay over time instead of all at once.

If the court agrees to a credit sale, the judge's order has to spell out exactly how the payments will work. It also has to state what security or guarantee will protect the minor if the buyer does not pay as promised. This keeps the minor's property and money safe even when payment is spread out over time.
