Art. 4641 Sale of interest of minor or interdict to effect partition

When a minor or a person under legal guardianship (called an interdict) owns a share of property along with other people, that share can be sold to divide up the property fairly among all the owners. This follows the same legal steps already set out in other parts of Louisiana law that cover how these sales work.

The rule also allows one of the other owners, someone who already shares ownership of the property, to be the one who buys out the minor's or interdict's share. This means the sale doesn't have to go to an outside buyer. A family member or co-owner can step in and purchase that portion directly, as long as the sale follows the proper legal process to protect the minor's or interdict's interests.
