Art. 4660 Injunctive relief

When someone starts a concursus proceeding, they are asking the court to settle who has the rightful claim to money or property that several people are fighting over. This happens when one person or company holds something that multiple people say belongs to them, and instead of facing separate lawsuits from each claimant, they ask the court to bring everyone together in one case.

This rule lets the judge stop the other side from filing or continuing separate lawsuits about the same claim. If the judge grants this kind of order, the people claiming the money or property cannot sue in any other court in Louisiana or in federal court over that same issue. They have to fight it out in the one concursus case instead.

The point of this rule is to keep the dispute contained in a single lawsuit. This saves time and money, and it stops people from getting different answers from different courts on the same question. It also protects the person or company holding the disputed property from having to defend themselves in several courts at once.
