Art. 4874 Withdrawal of demand for jury trial after transfer

If you file a motion to move your case (a transfer) under this chapter, that action counts as you asking for a jury trial. You can't just change your mind later and drop that request on your own.

To withdraw your jury trial demand after this happens, you need two things: the court has to agree, and the other side (or sides) in the case has to agree too. Both sides and the judge need to be on board before you can back out of the jury trial request.

This rule matters because it stops people from asking for a jury trial to help get their case transferred, and then quietly dropping the jury request once the transfer goes through. Once you make that move, you're generally locked into the jury trial demand unless everyone agrees to let you withdraw it.
