Art. 5153 Transferee in revocatory action; right to plead discussion

If someone owes you money and tries to get rid of their property by transferring it to someone else, you as the creditor can file a lawsuit called a revocatory action to cancel that transfer. This lets you go after the property to pay off the debt, even though it now belongs to someone else.

But the person who received the property (the transferee) has a defense available. They can ask the court to require you to first get a judgment against the original debtor and try to collect the debt directly from them. This is called "pleading discussion." Basically, the transferee can tell the court: go after the debtor first before you come after the property I now own.

This rule gives some protection to people who received property in a transfer, even if that transfer is later questioned. It makes sure the creditor tries the more direct route of collecting from the actual debtor before undoing a property transfer and going after someone else's assets.
