Art. 695 Absent or mentally incompetent managing spouse

If a married couple owns property or has a legal right together, normally the spouse who manages that specific property or right is the one who can sue to protect it. But sometimes that managing spouse cannot act. Maybe they have disappeared and cannot be found, or maybe a doctor or court has determined they are mentally incompetent.

When this happens, the law does not leave the family right unprotected. The other spouse steps in and gets legal permission to file the lawsuit instead. This means a family's shared property or financial interests can still be defended in court even if one spouse is missing or unable to make decisions.

This rule matters because it prevents legal problems from piling up just because one spouse is unavailable. It gives the present, capable spouse a clear path to go to court and protect what belongs to the marriage, without needing extra permission or a lengthy legal process to prove they have the right to act.
