Art. 743 Absent or mentally incompetent managing spouse

When a couple owns property together and one spouse normally handles the finances or business matters, but that spouse is missing or unable to make decisions because of a mental incapacity, the law needs someone else to answer for any debts tied to that property. In this situation, the other spouse becomes the person who can be sued if someone wants to collect on a debt connected to shared property.
