Art. 865 Construction of pleadings

When a judge reads something filed in a case, like a petition, motion, or answer, they should look at what the person actually meant, not just pick apart small mistakes in wording. The goal is to focus on fairness, not to throw out a case or claim because of a technical slip-up in how it was written.

This matters because not everyone who files papers in court is a trained lawyer, and even lawyers make wording mistakes sometimes. If the meaning is clear enough and the other side isn't unfairly hurt by it, courts are supposed to work with what was filed instead of punishing someone for imperfect language. The bigger goal is making sure real disputes get decided on their merits, rather than getting tossed out over paperwork errors.
