Art. 201 Arrest defined

When someone is arrested, it means they are being taken into custody by another person, usually a police officer. For an arrest to actually happen, the person has to be physically restrained in some way. This doesn't always mean handcuffs or force. It just means their freedom to walk away is taken from them.

There are two ways this restraint can happen. An officer might physically stop someone from leaving, using force or control over their body. Or the person might simply give up and accept that they're being taken into custody, without any physical struggle at all. Either way counts as an arrest under the law.

This matters because once an arrest happens, certain rights and protections kick in. Knowing what counts as an arrest helps clarify when those protections begin, whether or not handcuffs were used or a person physically resisted.
