Art. 265 Governor's warrant; issuance and recitals

Here's what this rule means: when the governor of Louisiana agrees that someone should be sent to another state to face charges, he signs an official arrest warrant. This warrant tells a law enforcement officer to arrest the person named in it.

The warrant needs to include facts showing the extradition request followed the proper legal process. This means it should show that the basic requirements for extradition were met.

However, the rule also includes a safety net. If the warrant leaves out some details or doesn't fully spell out every fact, that alone doesn't make the warrant invalid. As long as there was a real, proper basis for issuing the warrant in the first place, small gaps in the paperwork won't cancel it out. This protects the extradition process from being thrown out over minor clerical mistakes, as long as everything was legitimate to begin with.
