Art. 352 Venue

If you want to file a habeas corpus petition to challenge someone's detention, you have to file it in the parish where that person is currently being held. It doesn't matter where the arrest happened, where the crime allegedly took place, or where the person lives. What matters is the location of the jail or facility where they're being held right now.

This rule keeps things simple and avoids confusion about where a case should be heard. It also makes practical sense because the court in that parish will have easier access to the facility, the records, and the people involved in the person's custody. If someone is moved to a different parish while their case is pending, this location requirement is tied to where they are actually held, not where they started out.
