Art. 443 When indictment to be found

When a grand jury reviews evidence in a case, it can issue an indictment (a formal charge) against someone. The grand jury will do this if it believes the evidence, as presented, is strong enough to lead to a conviction. This means the jurors don't need to hear the other side of the story or any explanations from the accused person. They only need to decide if the evidence they were given, standing on its own, points to guilt.

In practical terms, this rule sets a fairly low bar for issuing an indictment. It does not mean the person is guilty. It simply means the grand jury believes there is enough evidence to move forward with formal charges and let the case proceed toward trial, where both sides will eventually have the chance to present their full case.
