Art. 488 Variances; amendment

When prosecutors write up criminal charges, they include specific details about what happened. Sometimes the evidence presented at trial doesn't quite match those details written in the charging papers. This is called a "variance."

When this kind of mismatch happens, the court doesn't have to throw out the case or refuse the evidence. Instead, the judge can allow the charging papers to be changed so they match what the evidence actually shows. Once that change is made, the evidence can be used in the case.

This rule gives courts flexibility. Small differences between what was written down and what the evidence shows don't automatically ruin a case. The judge can fix the paperwork to line up with the facts, as long as it doesn't unfairly harm the person being charged. This keeps minor errors or wording issues from letting someone escape a case on a technicality, while still making sure the charges accurately reflect the evidence.
