Art. 495 Objections to misjoinder

If you believe charges or defendants have been wrongly combined in the same case, there's only one way to challenge it: file a motion to quash the indictment. You can't raise this problem through other objections or motions during trial.

This matters because timing and method count. If defendants are charged together when they shouldn't be, or if separate crimes are improperly joined into one case, the person raising this issue must use the specific legal tool the law requires. Trying to object in a different way, like waiting until trial to bring it up, won't work.

For someone facing charges, this means talking to a lawyer early about whether the case has been put together correctly. If there's a problem with how charges or co-defendants were joined, that issue needs to be raised through a motion to quash before moving forward, not saved for later in the process.
