Art. 574 Conviction and punishment for lesser offenses; limitations applicable

When someone is charged with a crime but ends up convicted of a lesser charge that's included within it, the same time deadlines apply. The court doesn't use a different deadline just because the final conviction was for a smaller crime than what was originally charged.

For example, if someone is charged with a serious offense but the court finds them guilty of a lesser offense that's part of that charge, prosecutors and the court still had to follow the time limits that applied to the original, more serious charge. Louisiana law generally requires cases to move forward within certain deadlines after charges are filed. This rule makes clear that those same deadlines cover any lesser offense that might end up being the actual conviction, so people can't get around the time limits just because the outcome was a lesser charge.
