Art. 593 Method of pleading

If someone believes they are being tried twice for the same crime, they can't just bring it up casually in court. They have to file a written motion explaining the problem clearly.

The written motion needs to include specific details. It must name the court where the earlier case happened, describe the earlier proceeding where the person was already put in jeopardy, and explain the facts that show why this new case counts as double jeopardy.

This rule exists so the court has clear, written proof of the claim instead of a vague verbal objection. It also gives the prosecution a fair chance to see the exact argument and respond to it. If the motion is missing any of these details, the court may not accept it as a valid double jeopardy claim.
