Art. 597 Prosecution in other jurisdiction

If someone was already tried for something under federal law or another state's law, Louisiana can still bring its own charges against that person for the same conduct. The fact that they already faced prosecution elsewhere doesn't stop Louisiana from prosecuting them under its own laws.

This means double jeopardy protections only block a second trial when both cases are prosecuted under Louisiana law. If the first trial happened in federal court or in a different state, that earlier case doesn't count for double jeopardy purposes in a Louisiana court. Louisiana treats its own criminal laws as separate from federal law and the laws of other states, so facing charges in one system doesn't protect a person from facing charges in Louisiana for the same actions.

In short, being tried and even convicted or acquitted under federal law or another state's law will not stop Louisiana from bringing its own separate case based on that same conduct.
