Art. 767 Same; prohibition against adverting to confessions

This rule stops the prosecution from mentioning a confession or an incriminating statement made by the defendant during its opening statement, unless a judge has already decided that the statement can be used as evidence in the case. In other words, the prosecutor cannot bring up something the defendant supposedly said until it has been legally cleared for use in the trial.

The reason for this rule is fairness. If the prosecutor talked about a confession before a judge approved it, jurors might hear about it and be influenced even if the statement later gets thrown out. This rule makes sure the jury only hears about a confession if it has already passed legal review.
