Art. 816 Verdict acquitting on account of insanity

If a defendant has formally entered a plea of insanity in their case, the jury has another option when reaching a verdict. Along with the usual choices, like guilty or not guilty, the jury can also find the person "not guilty by reason of insanity."

This option only becomes available if the defendant took the proper legal steps ahead of time, using the process described in Article 552, to raise insanity as part of their defense. Without that formal plea, the jury would not have this verdict as a choice.

This matters because a finding of not guilty by reason of insanity is different from a regular not guilty verdict. It usually means the person is not sent home free. Instead, courts often order further evaluation or treatment, since the verdict recognizes that the person committed the act but was not mentally capable of being held criminally responsible for it at the time.
