Art. 842 Codefendants; presumption as to objections

When two or more people are being tried together in the same criminal case, and one of them objects to something during the trial, the law assumes that objection was made on behalf of all the defendants, not just the one who spoke up.

This means each defendant doesn't have to repeat the same objection separately to get its benefit. If their lawyer stays quiet while a co-defendant's lawyer objects, the court still treats it as if they objected too.

This assumption only holds unless something in the record shows otherwise. For example, if a defendant's lawyer clearly states they don't join in the objection, or the situation makes it obvious the objection only applies to one person, then the presumption won't apply to everyone.

In short, this rule saves time and protects defendants who are tried together. It keeps lawyers from having to repeat the same objections over and over just to make sure each client is covered.
