Art. 858 Review of ruling on motion for new trial

If a judge decides to grant or deny a request for a new trial, that decision usually can't be challenged in a higher court. The Louisiana Supreme Court won't step in to second-guess this kind of ruling just because someone disagrees with it.

The only exception is if the judge made a mistake about the law. In that case, the higher court can review what happened. But if the judge simply used their own judgment based on the facts of the case, that decision is final and can't be appealed further.

This means people involved in a case can't keep fighting over a new trial decision unless they can point to an actual legal error, not just a disagreement with how the judge saw the facts.
