Art. 861 Time for filing motion in arrest

If a defendant wants to challenge their conviction through a "motion in arrest of judgment," they have to file it and get it resolved before the judge hands down a sentence. Once sentencing happens, this option is off the table.

If the defense needs more time to put this motion together, they can ask the judge to delay sentencing. The judge can grant this request, but only if the defendant shows a good reason for needing the extra time. The delay is for a set period, not an open-ended postponement.

In short, this rule sets a deadline. The motion has to happen before sentencing, and any extra time to prepare has to be requested and justified ahead of that deadline.
