Art. 893.1 Motion to invoke firearm sentencing provision

When a person is charged with a crime involving a firearm, the prosecutor may want to ask the judge for a tougher sentence because a gun was used. This rule says the prosecutor has to let the court and the defendant know about this ahead of time, before the trial starts. They cannot wait until after a conviction to bring it up.

The prosecutor has to file a written request, called a motion, within a reasonable amount of time before the trial begins. This gives the defendant fair notice and time to prepare a defense against the firearm sentencing claim, not just the underlying charge.

The written motion also has to clearly explain why the prosecutor believes the firearm sentencing rule applies. It needs to lay out the basic facts supporting the request and point to the exact legal provision the prosecutor is relying on. This keeps things clear and fair, so the defendant knows exactly what is being claimed and can respond to it properly.
