Art. 926.4 Privilege waiver

If someone in a criminal case says their lawyer did a bad job (this is called an "ineffective assistance of counsel" claim), they automatically give up their right to keep conversations with that lawyer private. This is known as attorney-client privilege, and normally it protects everything said between a client and their lawyer.

Once this claim is made, the state can look into whatever information it needs to fight back against the claim. This means the old lawyer might have to share details about the case, like why certain decisions were made or what advice was given, even if that information would normally stay private.

The idea behind this rule is fairness. If a defendant is going to argue that their lawyer messed up, the state needs a way to check that claim and respond to it. The defendant cannot use the privilege as a shield while also attacking their lawyer's performance in court. The waiver only covers information that is actually needed to address the specific claim being made, not every private conversation the person ever had with their lawyer.
