Art. 981 Judgment granting motion to expunge a record of arrest or conviction; execution

If a judge grants your request to expunge (clear) your arrest or conviction record, that judgment has to be officially delivered to certain agencies and offices, following the rules laid out in Article 982. This is not just a formality. The expungement only applies to the specific agencies and people who actually receive a copy of the judgment.

This means if an agency or entity is not properly served with the motion and the judgment, your expungement does not affect their records. They can keep the record as if nothing changed. So it is not enough to just win your case in court. You need to make sure every agency listed under Articles 979 and 982 actually gets served, or your record may still show up in their files.
