Rule 49.1 Voluntary Transfer of Custody

When a parent wants to voluntarily hand over custody of their child, this rule explains how that process works in Louisiana courts. The key point is that this type of transfer only applies when custody is moving from a parent to someone who is not a parent, like a grandparent, relative, or family friend. If two parents (whether legally recognized or not) are trying to sort out custody between themselves, they cannot use this process. Instead, they need to go through regular district court proceedings or use a Provisional Custody by Mandate, which is a different legal tool made for that situation.

If someone wants to file for a voluntary transfer of custody, they usually have to do it as a new case, following the specific steps laid out in the Children's Code. However, if there is already an open case in court, the person may be able to add this request to that existing case, but only if the judge gives permission first. There's one more important detail: if there's an open juvenile case involving the child that the state hasn't formally closed, the state must be notified whenever someone asks to transfer custody. This ensures that if the state has any ongoing interest or concerns about the child's welfare, they know about the change and can respond if needed.
