Art. 1104 State v. Prieur; pretrial; burden of proof

Before a criminal trial starts, the prosecution sometimes wants to bring up evidence of other crimes or bad acts the defendant may have committed in the past. This rule sets the standard prosecutors must meet before a judge will allow that evidence in.

The rule says Louisiana courts must use the same standard as the federal court system uses under Federal Rule of Evidence 404. In practice, this means the prosecution does not have to prove beyond doubt that the defendant actually committed the other act. They just need to show enough evidence that a reasonable person could believe the defendant committed it.

For someone facing charges, this matters because it affects how easily prosecutors can bring up past behavior to argue about things like motive, intent, or a pattern of conduct. The hearing happens before trial so the judge can decide whether this kind of evidence is fair to use, without the jury being influenced before that decision is made.
