Art. 413 Settlement or tender

If someone pays money to settle a case, or offers money as a tender, that payment usually cannot be brought up as evidence in court. This protects people who try to resolve a dispute by paying money, so they don't get penalized later for trying to make things right.

There's one exception. If the case is actually about whether someone failed to settle or failed to make a tender, then this information can come into evidence. In that specific situation, the payment (or lack of one) becomes relevant to what the court needs to decide.

The idea behind this rule is to encourage people to settle disputes without fear that their settlement offer will be used against them. If every payment or offer could be used as proof of guilt or fault, people would be less willing to resolve cases outside of a full trial.
