Art. 605 Disqualification of judge as witness

A judge cannot take the witness stand and testify in the same trial they are running. Their job is to oversee the case and make rulings, not to give testimony about facts. Mixing these two roles would create an unfair situation and confuse the jury about the judge's true role.

If a judge tries to testify, the lawyers do not even need to object. The problem is automatically preserved for appeal. This means if this ever happened and the case was appealed, the higher court would still look at the issue even without a formal objection being made at the time.
