Art. 802 Hearsay rule

Hearsay is basically an out-of-court statement that someone brings up in court to prove that what was said is true. For example, if a witness says "My neighbor told me she saw the car speeding," that's hearsay if it's being used to prove the car was actually speeding.

This rule says that hearsay generally cannot be used as evidence in court. The idea behind this is fairness. When someone makes a statement outside of court, the other side never got a chance to question them about it, challenge their memory, or test whether they were being honest. Courts want people to testify in person, under oath, so both sides can ask questions and the judge or jury can judge whether the person is believable.

That said, this rule is not absolute. There are many exceptions written into Louisiana law that allow certain kinds of hearsay to be used, such as statements made for medical treatment or business records kept in the normal course of work. So while hearsay is blocked by default, it can still come into a case if it fits one of those recognized exceptions.
