Rule 3.202 Capacity to Sue

Most people can sue or be sued on their own behalf, but children and people who have been found mentally incompetent need special help in court. There are separate rules (found in MCR 2.201) that spell out exactly how that process works for them.

There is one exception for minors. If a minor has been legally emancipated, meaning a court has granted them adult status before they turn 18, they can sue and be sued using their own name, just like an adult would.
