Rule 3.717 Dismissals

If someone files for an extreme risk protection order and then changes their mind, they can ask the court to drop the case. However, they must make this request before the court actually issues the order. There is no filing fee to make this request.

Once the court has issued an order, the petitioner cannot simply ask to have the case dismissed under this rule. There are a few exceptions listed in other rules (MCR 3.718(B), 3.718(D), and 3.720) that may apply in certain situations. Courts can also dismiss a case for other legal reasons allowed under the law.
