If a man believes he may be the father of a child born outside of marriage, he can sign legal papers giving up his parental rights at any point after the pregnancy begins. If that man admits he is the father and the child is a Native American child, the court must notify him about any hearings related to the case.

Any signed release or consent form is considered valid as long as it followed the rules that were in place at the time it was signed. This means the court looks at the law from when the document was signed, not the law as it stands today.
