Rule 5.151 Jury Trial, Applicable Rules

When a probate court case goes to a jury trial, the court follows the same basic jury trial rules that apply to other civil cases in Michigan. These rules cover things like how jurors are selected, how they are instructed, and how they reach a verdict.

There are two exceptions to this. If the case involves mental health proceedings, special rules under MCR 5.740 apply instead. Also, some rules specific to probate court can change how the general jury trial rules work.
