Rule 5.301 Applicability

These rules cover court cases that deal with a deceased person's estate. If someone dies and their belongings, money, or property need to go through the court system, this set of rules explains how that process works.

There is one exception. If the estate is small enough to qualify for a simplified process under Michigan law (MCL 700.3982), these rules do not apply. Small estates have their own separate, simpler process.
