Rule 5.747 Petition for Discharge of Individual

If someone in a mental health case wants to be released, they can ask the court for a discharge. The person or agency trying to keep them in treatment has to prove to the court that continued treatment is still needed.

This is different from how many legal proceedings work. The patient does not have to prove they are well enough to leave. Instead, the other side must show why the person should stay in treatment.
