Rule 6.417 Mistrial

If a judge is thinking about declaring a mistrial, they cannot just do it on their own. They must first give both sides a chance to speak up. This happens on the record, meaning everything said is officially documented.

Each defendant and the prosecutor gets to share their opinion about whether a mistrial is the right call. They can say yes or no, and they can also suggest other options the judge might not have considered.
