Rule 705 Disclosing the Facts or Data Underlying an Expert’s Opinion

When an expert witness shares their opinion in court, they do not have to explain all the background information and data they used before giving that opinion. They can simply state what they think and why.

However, the other side in the case can ask the expert about that background information during cross-examination. This gives both sides a fair chance to examine what the expert based their opinion on.
