Rule 8.02 Removal of Disability

If a minor (someone under 18) wants a court to remove their legal disability status, they usually have to appear in person before the chancellor (the judge). This gives the judge a chance to see and question the minor directly before making a decision. The judge can excuse the minor from appearing in person, but this only happens in special situations.

The court also needs proof to back up the request. This means someone has to give spoken testimony in court, or provide sworn written statements called affidavits. The judge cannot just take someone's word for it. There has to be real evidence showing why removing the minor's disability makes sense.

This rule exists to protect minors. Since removing a disability status changes a young person's legal rights and responsibilities, the court wants to make sure the decision is based on solid evidence and, when possible, a face to face meeting with the minor involved.
