Rule 2.03 Rescheduling Trials

If your case has a trial date, you can't just change it on your own. Only a judge can move the trial date to a different time. This applies no matter who wants the change, whether it's you, the other side, or both parties agreeing together.

If you need to push back a trial date, you have to ask the court for permission first. You can't assume that a request will be automatically approved, or that the other side agreeing to a delay is enough on its own. The judge has the final say on whether the trial gets rescheduled.

This rule exists to keep cases moving and prevent trials from being delayed over and over without good reason. Courts have busy schedules, and last minute changes can cause problems for everyone involved, including witnesses, jurors, and other cases waiting for court time. If you think you have a good reason to delay a trial, talk to your attorney about filing a formal request with the court as soon as possible.
