Rule 32.6 Bail

If someone is jailed for contempt of court and wants to appeal that decision, they have the same rights to bail as anyone else who was convicted of a crime and is appealing their case. This means the court cannot treat a contempt case differently or more harshly when deciding whether to release the person on bail while their appeal moves forward.

In practice, this means the judge looks at the same standard factors used in any criminal case. These typically include things like whether the person is likely to show up for future court dates, whether they pose a danger to others, and whether their appeal raises real legal questions worth considering. Being held in contempt does not put someone at a disadvantage compared to other defendants when it comes to getting bail during an appeal.
