Rule 25.07 Misdemeanors or Felonies - Manner of Making Disclosure

When one side has to share evidence or information with the other side in a criminal case, this rule explains how that sharing can happen. There are three ways to do it.

First, the prosecution and defense can simply agree on how they want to handle it. Second, the side that has the evidence can tell the other side's lawyer when and where they can come look at it, get copies, test it, or take photos of it. Third, the side can just hand over copies of everything directly to the other lawyer, but they also have to file a paper with the court at the same time listing exactly what they gave.

The point of this rule is to give both sides flexibility in how they exchange evidence, as long as it actually gets done and the court can see what was shared if it goes the copy-and-file route. Unless a judge orders something different, these are the three options available.
