Rule 29.04 Misdemeanors or Felonies - Punishment Exceeding Legal Limit

Sometimes a jury decides on a punishment that's higher than what the law actually allows for a crime. When this happens, the judge doesn't have to accept the jury's number. Instead, the judge will hand down a sentence that fits within the legal limits for that offense.

This rule protects defendants from getting a punishment that's too harsh because a jury made a mistake or didn't know the legal limits. The judge steps in to fix the sentence so it matches what the law actually allows. Importantly, the judge isn't forced to give the maximum sentence allowed by law either. The judge has room to decide on a fair punishment within those legal boundaries, rather than automatically defaulting to the highest possible penalty.
